Legislative Drafter
Writes the precise wording of bills, rules and government notifications.
Facts checked 29/10/2026
Is this for me?
- Careful reading and exact, clear writing
- Solving puzzles of language and law
- Knowing your words become real rules for millions of people
- A long road: LLB, then years of legal experience before the central post
- Very few vacancies, advertised only now and then
- Quiet, detailed desk work, often under deadline pressure, with little public credit
- Class 11–12 subjects
- Class 12 in any stream. For the 5-year law degree through CLAT, National Law Universities usually ask for at least 45% in Class 12 (reported). Reading, writing and careful thinking matter more than any one subject.
- First degree
- LLB: a 5-year integrated BA LLB after Class 12, or a 3-year LLB after any graduation. An LLM is optional, but it counts towards the central drafting post if you also teach or research law.
- Entrance exams
- CLAT (Consortium of NLUs) or a university law entrance for the LLB. After that there is no fixed yearly drafting exam. For the central post of Assistant Legislative Counsel, UPSC advertises vacancies from time to time. It shortlists applicants, may hold a Recruitment Test, and then holds an interview. State legislatures and law departments run their own recruitment.
- Licence or registration
- None needed to start working.
What the work is like
Turning a policy decision into exact legal wording. You draft bills, rules, regulations and notifications. You check other departments' drafts for errors and conflicts with existing laws. You also work with ministries, lawyers and officers until every word means only one thing.
A day in the work
You reach the office in Delhi or a state capital and start with a ministry's request: turn a decision into a bill. You read the old Acts it touches, then write clause by clause. After lunch you meet an officer who wants a change, and you explain why one word could cause a court case. In the evening you check a colleague's draft for mistakes, and in Parliament or Assembly sessions you may stay late.
The path, step by step
- Step 1 · Class 9–12Take any stream. Build the habits this work needs: careful reading, clear writing in English and/or Hindi, and civics or political science. Drafting is about precise language, so a lawyer's mind and an editor's eye both help.
- Step 2 · Class 12Apply for a law degree. Sit CLAT for the National Law Universities (the last cycle, CLAT 2026, was held in December 2025), or another university's law entrance. Another way is to do any 3-year degree first and then a 3-year LLB. Choose only a Bar Council of India–recognised law course; distance or online LLBs are not accepted for enrolment (reported). (reported — check with the official body)
- Step 3 · 3 to 5 yearsComplete the LLB. Moot courts, legal writing, internships with a lawyer, court, legislature or government legal department all count as useful practice.
- Step 4 · Years of experienceYou cannot go straight from LLB to the central drafting post. For Assistant Legislative Counsel, UPSC's 2026 notice asks for a law degree plus experience: 7 years in a State Judicial Service, 7 years in a senior State legal department post, 7 years in legal affairs in the Central Government, an LLM with 5 years of law teaching or research, or being a qualified legal practitioner aged at least 30. Drafting experience gets preference. The rules count 'legal affairs' to include drafting, pleadings and legal advice (Legislative Department rules, 2025).
- Step 5 · SelectionWatch for UPSC advertisements for the Legislative Department. UPSC's 2026 notice (Advt. No. 12/2026, applications 26 Sep–16 Oct 2026) invited online applications for 8 posts of Assistant Legislative Counsel. Selection is by shortlisting, a Recruitment Test only if applications are many, and then an interview. Maximum age was 40 (General/EWS), 43 (OBC) and 45 (SC). Other posts, such as the Legislative Department's own Assistant (Legal), and state law departments and legislature secretariats, recruit separately; each state has its own rules.
- Step 6 · Probation and growthThe post is permanent, Group A Gazetted, in Grade IV of the Indian Legal Service, with a probation period (two years, reported). Promotion goes through Deputy Legislative Counsel and Additional Legislative Counsel to Joint Secretary and Legislative Counsel (ILS Rules, 1957 as amended). (reported — check with the official body)

- Central government: support postsLegislative Department also recruits legal assistants and other staff. In a 2025 notice, Assistant (Legal) asked for an LLB plus 2 years of legal experience (reported). This is a way to build drafting experience.

Government drafters are paid on a fixed pay scale that rises with promotion, so pay depends on your grade and years of service; state posts and private legal work can pay quite differently.
Myth and fact
For girls and students with disabilities
UPSC's 2026 notice kept one of the 8 Assistant Legislative Counsel posts for candidates with disabilities (PwBD), and reservations applied for SC, OBC and EWS candidates. Age relaxation for PwBD is up to 10 years, and women, SC/ST and PwBD candidates paid no fee (both reported). Check each new notice, as rules can change.

Good to know
- Drafters usually work behind the scenes. Ministries and elected members decide the policy; drafters give it legal shape.
- The central post is advertised only occasionally and in small numbers, so it helps to keep a second legal career option open.
- Pay and rules above are from the 2026 UPSC notice and the Indian Legal Service Rules. The Central Government's pay levels can change after a new Pay Commission, so check the latest notice.
- Legal enrolment as an advocate (State Bar Council, then the AIBE exam) is needed only if you plan to practise in court. Years of practice can count towards the experience the central post asks for.
