Is this for me?

People in this work enjoy
  • Understanding new technology, from a medical device to a mobile app
  • Careful writing, where one word choice matters
  • Working with inventors and learning something new each week
It may not suit you if you dislike
  • A lot of reading and drafting at a desk, often to strict deadlines
  • The exam is tough: in 2026 only a small share of those who registered finally qualified, and you may need more than one attempt
  • Building a client base takes time if you want to work on your own
Class 11–12 subjects
No Class 12 rule of its own. The law asks for a degree in science, engineering or technology, so most students take PCM or PCB in Class 11–12 to get into a B.Tech, B.Sc or similar course.
First degree
A bachelor's degree in science, engineering or technology from an Indian university (B.Tech, B.E., B.Sc and similar; usually 3–4 years). A diploma on its own is not a degree.
Entrance exams
Patent Agent Examination, held once a year by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM). It has Paper I (objective, 100 marks), Paper II (descriptive drafting, 100 marks) and a viva voce (50 marks).
Licence or registration
You must be entered in the Register of Patent Agents after passing the exam. You get a certificate of registration, applied for on Form 22. Only then can you practise as a patent agent.

What the work is like

Understanding an invention, writing the patent application (the 'specification' and its claims), filing it, replying to objections from the Patent Office, and sometimes attending hearings. Also advising on whether an idea is new enough to patent.

A day in the work
You start by reading an inventor's notes or a technical drawing, then ask questions until you really understand how the invention works. Next you spend a few hours drafting claims, which are precise sentences that say exactly what the inventor owns. After lunch you may reply to an objection from the Patent Office or search older patents to see if the idea is new. Some days end with a call to an inventor or a company's R&D team to explain what can and cannot be protected.

Professional qualificationRun by Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM), Indian Patent Office. You can start after: A degree in science, engineering or technology. Minimum time: About 3–4 years of degree, plus the exam cycle (written, viva and registration take roughly 3 months after the January exam).

The full route: exams, training, registration

  1. Step 1 · Class 11–12Take the science stream (PCM or PCB). The law needs a degree in science, engineering or technology, and patent work is easier if you enjoy understanding how things work.
  2. Step 2 · 3–4 years after Class 12Complete a B.Tech, B.E., B.Sc or similar degree from an Indian university. Any branch of science or engineering counts. The candidate has to check their own eligibility, because the Patent Office does not do it for you at the time of applying.
  3. Step 3 · Age 21 or aboveYou must be an Indian citizen and at least 21. Apply online only, once the yearly notice is out. For the 2027 exam the window ran 1 July to 30 September 2026 and the fee was ₹1,600. The window has now closed, so the next chance is the following year's notice.
  4. Step 4 · Written examPaper I is objective (2 hours) on the Patents Act, Patents Rules, Designs Act and Designs Rules. Paper II is descriptive (3 hours) on drafting and interpreting patent specifications. You need at least 50 marks out of 100 in each paper to reach the viva. The 2026 exam was held on 11 January 2026 in 13 cities. The 2027 exam is tentatively set for January 2027 (reported). (reported — check with the official body)
  5. Step 5 · Viva voceA 50-mark interview in person, held about a month after the written results. To pass, your total across both papers and the viva must be at least 60% of the 250 marks.
  6. Step 6 · RegistrationAfter passing, apply on Form 22 with your degree certificate, proof of age and citizenship, a character certificate and your signed admit card. Pay the registration fee. Your name then goes into the Register of Patent Agents.
  7. OptionalMany agents work first in an IP firm or a company's patent team to learn drafting. Some add an LLB to become a patent attorney.
Recently changed, or still changing
  • The exam is held once a year and you apply fresh each time. For the 2027 exam the registration window was 1 July to 30 September 2026, and the office said it would not be extended.
  • The exam fee was ₹1,600 for the 2026 and 2027 exams.
  • The exam rules are in Rule 110 of the Patents Rules, 2003. The notice for each year can change details such as centres and dates.

Your real chances

In the 2026 exam (held 11 January 2026), 5,535 candidates registered. Of these, 2,402 appeared in Paper I and 2,315 in Paper II. Only a few hundred reached the viva stage, and fewer qualified finally (reported). There is no fixed number of seats; anyone who clears the marks gets registered.

What people earn

Earnings vary a lot: freshers in IP firms usually start modestly and grow as their drafting improves, big-city firms and companies pay more than small practices, and independent agents earn according to how many clients they build.

Myth and fact

Myth: You need to be a lawyer to become a patent agent.
Fact: No. The law asks for a degree in science, engineering or technology and a pass in the patent agent exam. A law degree is not required.

For girls and students with disabilities

The 2027 exam notice allows candidates with disabilities to ask the office for help in the exam by applying early with a valid disability certificate. The Patents Act sets no maximum age. It sets only a minimum of 21, so women and men can enter at any stage of life.

Try it now

  • Class 7–9Pick one everyday object (a bottle cap, a school bag strap, a phone stand). Write 5 lines on what problem it solves and how it could be made better. That habit is the start of thinking like an inventor.
  • Class 10–12Open Google Patents and look up a patent for something you know, like a bicycle or a pen. Read the abstract and the first claim, and try to explain it in your own words.Open link ↗
  • College or afterDownload a past Patent Agent Examination question paper from the IP India page and read how the questions are framed. Also look for a free NPTEL or SWAYAM course on intellectual property rights.Open link ↗

Good to know

  • You do not need a law degree to be a patent agent. You need a science or engineering degree. A law degree is a separate, optional add-on.
  • A company or firm cannot be registered as a patent agent. Only individuals can (reported).
  • A second route exists in the Act for people who served at least 10 years as a patent examiner or in the Controller's functions. It is not a route for students.
