Is this for me?

People in this work enjoy
  • Reading rules closely and solving small legal puzzles
  • Working with brands, logos and business owners across many industries
  • Steady, desk-based work with a clear step-by-step process
It may not suit you if you dislike
  • A lot of reading and drafting, and strict deadlines where a small mistake matters
  • The exam is only once a year, and the pass rate looks low (about 60 shortlisted for the 2026 viva, reported)
  • Income can be slow at first, and you may have to build your own clients
Class 11–12 subjects
No fixed Class 11–12 subjects. You need a degree in any subject from an Indian university (or an equivalent qualification). Strong English and careful reading help a lot.
First degree
Any bachelor's degree (BA, BCom, BSc, BBA, BTech, LLB and so on), usually 3 years. An LLB is not compulsory.
Entrance exams
Trade Marks Agent Examination, held by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM). It has Paper I (objective, 2 hours, 100 marks), Paper II (descriptive, 3 hours, 100 marks) and then a viva voce (interview) for those who qualify. Advocates and members of the Institute of Company Secretaries of India (ICSI) do not need to pass this exam.
Licence or registration
You must be entered in the Register of Trade Marks Agents (application on Form TM-G). You also need to be an Indian citizen, at least 21 years old, and judged a "fit and proper person" by the Registrar.

What the work is like

Searching whether a brand name is already taken, filing trademark applications, replying to objections from the Registry, handling oppositions, renewals and transfers of marks, and advising businesses on how to protect their brand. A registered agent can also work as a Geographical Indications (GI) agent.

A day in the work
You start by checking the Registry's online records for replies and hearing dates on your clients' files. Then you search whether a new client's brand name clashes with an existing mark, and explain the risks to them on a call. After lunch you draft a reply to an examination objection, or prepare papers for an opposition hearing. Before you leave, you file a few applications and renewals, and note the deadlines. Missing a deadline can cost a client their brand.

Professional qualificationRun by Office of the Controller General of Patents, Designs & Trade Marks (Trade Marks Registry), Ministry of Commerce and Industry. You can start after: Any degree, and age 21 or above. Minimum time: About 3 years after Class 12 for the degree, plus the next yearly exam cycle (roughly 6 months from application to final result).

The full route: exams, training, registration

  1. Step 1 · Class 7–12Any stream is fine. Work on English reading and writing, and on noticing small details. These are the skills you will use every day. Start noticing how brands, logos and look-alike names work.
  2. Step 2 · 3 years after Class 12Do any bachelor's degree. Law, commerce, science, design or management all lead here. Choose the subject you can do well in. An LLB is useful but not needed for the agent exam.
  3. Step 3 · Age 21 and a degreeCheck you meet Rule 144 of the Trade Marks Rules, 2017: Indian citizen, at least 21, a graduate, and "fit and proper". The 2027 exam notice says the office checks eligibility only when it issues the agent certificate. It also says a candidate who qualifies must hand in the qualifying degree within 6 months of the final result. Read the latest notice carefully to see if final-year students can sit.
  4. Step 4 · Apply onlineThe exam is held once a year. Applications are online only, on ipindia.gov.in. For the exam to be held on 9 January 2027 (tentative), applications ran from 1 July to 30 September 2026 and the deadline was not extended. That window is now closed. Watch the CGPDTM site for the next notice, which is usually announced in the first half of the year. The fee was ₹4,500 in the 2026 notice (check the new notice for the current fee).
  5. Step 5 · JanuaryWritten exam at one of the exam cities (15 cities for the 2027 exam). The syllabus is the Trade Marks Act 1999, the Trade Marks Rules 2017, the Geographical Indications of Goods Act 1999 and Rules 2002, and IP jurisprudence. Previous years' papers are on ipindia.gov.in.
  6. Step 6 · February–MarchCandidates who qualify in the written papers are called for a viva voce, held in person. Skipping the viva means you are out of the exam. Final results come around March. In 2026, only about 60 candidates were reported to be shortlisted for the viva. (reported — check with the official body)
  7. Step 7 · After the final resultSubmit your degree and your registration application and fee as the Registry asks. Your name then goes into the Register of Trade Marks Agents and you get a certificate. After that you can work in an IP law firm, a company, or on your own.

  • Company Secretary routeMembers of the Institute of Company Secretaries of India (ICSI) can also be registered without taking this exam.
Recently changed, or still changing
  • The exam is held once a year, and dates, cities and fees are set in each year's public notice. Always read the latest one.
  • The 2027 exam application window (1 July–30 September 2026) has closed, and the office said it would not extend it.

What people earn

Earnings depend heavily on where you work: new agents in firms usually start modestly, while experienced agents with a steady client base or a senior role in a big IP firm or company can earn much more, especially in metro cities.

Myth and fact

Myth: You need a law degree (LLB) to become a trademark agent.
Fact: Any graduate who is an Indian citizen and at least 21 can sit the agent exam. An LLB or a Company Secretary membership only gives you a way to register without the exam.

For girls and students with disabilities

Candidates with visual or physical disabilities can ask for help in the exam, such as a reader or writer. In the 2027 notice, the request had to be emailed with a disability certificate before 25 December 2026. The notice lists no separate women's quota or age relaxation.

Try it now

  • Class 7–9Pick 5 brands you use daily. Note each one's name, logo and slogan. Then invent a new snack brand and ask friends if the name sounds too close to a real one. This is the core of the work.
  • Class 10–12Take a free beginner course on intellectual property (trademarks, copyright, patents). The World Intellectual Property Organization (WIPO) offers free online courses.Open link ↗
  • College or afterDownload one past Trade Marks Agent exam paper from the CGPDTM site, read the questions, and look up the relevant sections of the Trade Marks Act, 1999.Open link ↗

Good to know

  • A trademark agent is not the same as a trademark lawyer. Agents handle filing and proceedings before the Registrar. Court cases and legal advice on disputes are usually handled by advocates.
  • The CGPDTM says it does not recognise any training institute for this exam. The Acts, Rules and past papers are free on ipindia.gov.in.
  • The Patent Agent exam is a separate exam with different degree rules. Check the Patents Act section 126 if you are a science or engineering graduate.
  • Dates, fees and the number of exam cities change with each year's notice, so always check ipindia.gov.in.
